Agreement to Terms

By downloading or using DadGainz ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms are between you and The Yard Apps ("we," "us," or "our").

Not Medical Advice

DadGainz is not a medical application and does not provide medical advice.

All content in the App — including exercise descriptions, workout suggestions, tracking features, and any other information — is provided for general informational and fitness tracking purposes only. Nothing in the App constitutes or should be construed as:

Medical advice, diagnosis, or treatment
A recommendation for any specific exercise, program, or physical activity
A substitute for professional medical advice, diagnosis, or treatment

Always consult a qualified physician or other licensed healthcare provider before beginning any new exercise program, particularly if you have or suspect you may have a medical condition, injury, or other health concern. Never disregard or delay seeking professional medical advice because of something you read or tracked in this App.

AI-Generated Content

DadGainz includes AI-powered features — AI Coach chat, AI Workout Generator, Program Builder, and Weekly Check-in — that produce responses using a large language model hosted by a third-party provider (Groq). Any content generated by these features is machine-generated, informational only, and not guaranteed to be accurate, safe, or appropriate for your specific situation.

You acknowledge that AI-generated workouts, coaching responses, and recommendations:

Are not medical, physical therapy, or professional fitness advice
May contain errors, outdated information, or recommendations that are not suited to your body, injuries, or experience level
Should be evaluated by you (or a qualified professional) before acting on them

The use of AI features also involves the transmission of limited training data to Groq. This is described in detail in our Privacy Policy at https://dadgainz.com/privacy. You may use DadGainz entirely without AI features if you prefer not to share any data with third parties.

Exercise at Your Own Risk

Physical exercise involves inherent risks, including the risk of injury or death. By using DadGainz to log, plan, or guide your physical activity, you acknowledge and accept that you exercise entirely at your own risk.

You agree that The Yard Apps is not responsible or liable for:

Any injury, illness, or adverse health outcome resulting from your use of the App or any physical activity you undertake
The accuracy or appropriateness of any exercise information included in the App for your specific circumstances
Any decision you make regarding your fitness or health based on use of the App

You are solely responsible for assessing your own physical condition and the risks involved in any exercise you perform.

Use of the App

DadGainz is licensed to you for personal, non-commercial use. You agree not to:

Reverse engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Attempt to extract or reuse any portion of the App's code or assets without permission

Subscriptions & Auto-Renewal

DadGainz offers an optional DadGainz Premium subscription that unlocks unlimited use of the AI-powered features (AI Coach, AI Workout Generator, AI Program Builder, and weekly AI recap). The core app — manual workout logging, progress tracking, exercise library — remains free.

Subscription terms:

Billing: Subscriptions are billed through your Google Play account. Current prices are shown in the app at the point of purchase. If you subscribe, payment will be charged to your Google Play account at confirmation of purchase.
Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual, depending on the plan you chose) unless you cancel at least 24 hours before the current period ends. The renewal charge will match the then-current price of the same plan.
Managing your subscription: You can view, cancel, or change your subscription anytime from your Google Play account at play.google.com/store/account/subscriptions. Cancelling turns off auto-renewal; your paid access continues until the end of the already-paid period.
Refunds: Refunds for accidental or unwanted charges are handled through Google Play's refund policy, typically allowing a request within 48 hours of purchase. We do not process refunds directly.
Free tier limits: Users who choose not to subscribe retain access to a limited free trial of the AI features (a small number of total uses, not a monthly allowance). These limits are disclosed in the app.
Fair-use daily limits (premium users): To prevent abuse, all users are subject to per-device daily fair-use caps on AI features: 100 AI Coach messages per day, 30 AI workout generations per day, and 20 AI program builder generations per day. These caps are generous by design — normal daily use is nowhere near them. They exist as a safety net against scripted or malicious traffic against the shared AI backend, not to meter legitimate usage. Caps reset at midnight local time.
Changes to pricing: We may change subscription prices from time to time. Any change will be disclosed in advance and will not apply to an existing paid period. Continued use after a price change constitutes acceptance of the new price for future periods.

No user accounts or credentials are required to subscribe; billing state is managed entirely by Google Play and tied to your Google account.

Intellectual Property

All content, design, code, graphics, and other materials in DadGainz are the property of The Yard Apps and are protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the App as described herein.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of bugs or viruses.

Limitation of Liability

To the fullest extent permitted by applicable law, The Yard Apps and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the App (if any).

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
